The Wilhelmshaven district court was founded on March 23, 1873 by Royal Prussian decree, which came into force on April 1, 1873. Initially, the court's jurisdiction only extended to the small Prussian part of what is now the city of Wilhelmshaven. The judicial authorities of the Grand Duchy of Oldenburg continued to be responsible for the surrounding villages.
Although the municipalities of Bant, Heppens and Neuende, which had since been merged to form the town of Rüstringen, were soon merged with the town of Wilhelmshaven for purely urban planning purposes, both district courts existed independently until the Gross-Hamburg Act of January 26, 1937, which separated the town of Wilhelmshaven from the Prussian state. The towns of Rüstringen and Wilhelmshaven were merged to form the town of Wilhelmshaven, which belonged to the Free State of Oldenburg, and the two district courts were merged to form the now Oldenburg district court of Wilhelmshaven.
The district court of Wilhelmshaven currently has 11 judges.
